This issue is resolved on the basis of the instructions of the traffic police, the text of which is given below in the historical background.
HISTORICAL REFERENCE
Before the Decree of the Government of the Russian Federation of May 10, 2010 N 316 was issued, not all cases were described in the traffic rules contradictions of signs and markings and the table was incomplete. It was these cases that were of the greatest interest to us.
Two most interesting cases were not described in the traffic rules, which, as a result, caused many disputes and courts:
Stationary sign contradicts temporary marking;
The stationary sign is contrary to permanent markings.
Let's look at the previous rules in relation to these two cases in more detail.
The stationary sign contradicts the time marking.
For some reason, this case was undeservedly ignored by specialists and left to the mercy of the traffic police. The layman has a belief that for the purposes of traffic rules, everything temporary takes precedence over permanent and every motorist is ready to agree with the traffic police officer that temporary markup takes precedence and over permanent markings and over stationary signs. But in fact, as we could see above, reading excerpts from the traffic rules, this is just a delusion, there were no such explanations in the traffic rules regarding contradictions between temporary marking and stationary sign, respectively, we received a legal conflict, and all doubts, as you know, are interpreted in favor of the accused.

This case, which in principle should not arise, but arises due to Russian reality, was also not reflected in the legislation in any way. However, in this case, the leadership of the traffic police came to our aid in 2008 quite unexpectedly, for which we can thank you very much, and wish you to continue to work just as clearly and guard the interests of drivers.

At the same time, in the situations described, the horizontal marking lines do not meet the requirements of road signs.
The most common cases are when there is a horizontal marking 1.5 on the road surface, separating traffic flows in opposite directions, and a road sign 3.20 "Overtaking is prohibited" is installed without specifying the area of validity of the introduced restriction or installing a road sign 3.21 "End of overtaking prohibition".
This combination of the above technical means of traffic management is unacceptable.
The above facts testify to the failure to comply with the instructions of the Minister of Internal Affairs of the Russian Federation dated August 1, 2007 No. 1/6080 regarding the exclusion of the facts of unreasonably installed road signs and applied roadway marking lines.
When exercising traffic supervision, as well as when considering disputable situations, when it is established that the horizontal marking lines do not meet the requirements of established road signs, the situation should be interpreted in favor of road users.
In accordance with the foregoing, in order to ensure road safety, as well as the observance of the legal rights of participants in the transport process,

How to behave in cases of occurrence of one of the described situations?
In cases of such situations discrepancies or contradictions of the road sign and markings in a conversation with a traffic police officer, you must refer to the Rules of the Road (the necessary excerpts are given above). This should be done immediately, when you were stopped, quickly assessing the situation. By showing your awareness, you will prevent violation of your rights.

Thirdly, a road sign is always more important than markings.

Many different situations can be cited when signs and markings come into conflict with each other. For example, the presence of a permanent continuous marking indicates that it is impossible to cross it, that is, overtaking and any maneuvers with exit to the oncoming one are prohibited. However, if there is a sign “Obstacle avoidance on the left” at the same time, then you can easily neglect the markup requirement and not be afraid that you will be fined for non-compliance with traffic rules.
If, for example, there is a sign “end of the no-overtaking zone” and a solid marking is applied, then this indicates that it is forbidden to drive into the oncoming lane to overtake, since this sign does not allow overtaking, but only indicates the end of the prohibition zone. That is, in this case, the sign and markup complement each other. If in this case a marking was applied that allowed driving into the oncoming lane, then overtaking could be done without fear of losing the rights.
